Terms of use

1. General Provisions

1.1. This Terms of Use Agreement (hereinafter — “Agreement”) governs the relationship between Individual Entrepreneur Dmitry Mikhailovich Pertsell (hereinafter — “Administration”, “Operator”, “We”) and any person using the website https://www.ghi-servers.ru (hereinafter — “Site”), including viewing, filling out forms, placing orders, subscribing to newsletters, and other actions (hereinafter — “User”, “You”).

1.2. Use of the Site constitutes full and unconditional acceptance of the terms of this Agreement. If you do not agree with the terms, please leave the Site and do not use its functionality.

1.3. The Administration reserves the right to amend the terms of the Agreement at any time without prior notice to the User. The new version becomes effective upon posting on the Site. Continued use of the Site after changes constitutes acceptance of the new version.

1.4. In matters of ordering and purchasing goods, the relationship between the User and the Administration is additionally governed by the Public Offer (Purchase and Sale Agreement) posted on the Site at /offer-en. In case of conflict, the provisions of the Public Offer shall prevail regarding purchase and sale.

2. User Status and Rights

2.1. The User may be any legally capable individual (over 18 years of age), as well as a legal entity or individual entrepreneur.

2.2. The User has the right to:

• view information about goods and services (server and IT equipment, components);
• place orders and feedback requests through forms on the Site;
• subscribe to informational newsletters (with the ability to unsubscribe);
• contact support via the contacts provided on the Site.

2.3. The User undertakes to:

• provide accurate and current information when filling out forms (full name, phone, email, delivery address);
• not use the Site to distribute malware, spam, offensive material;
• not violate the laws of the Russian Federation, including intellectual property rights;
• not take actions that could disrupt the normal operation of the Site (DDoS attacks, scraping, automated data collection without permission).

3. Intellectual Property

3.1. All materials posted on the Site (texts, images, logos, design, code) are the intellectual property of IP Pertsell Dmitry Mikhailovich or used under lawful license.

3.2. Copying, distribution, modification, or commercial use of Site materials without written permission from the Administration is prohibited.

3.3. Quoting materials is permitted with a mandatory link to the Site and attribution.

4. Acceptance of the Agreement

4.1. Acceptance of the terms of this Agreement is deemed to occur upon any of the following actions:

• use of the Site (viewing pages);
• filling out an order form or feedback request and clicking “Submit”;
• checking the box “I accept the Terms of Use and give my consent to the processing of personal data“.

4.2. Acceptance of the Agreement does not require a separate signature and has full legal force in accordance with Art. 438 of the Civil Code of the Russian Federation.

5. Orders and Cancellation

5.1. Placing an order through the Site does not constitute remote payment. After processing the order, the manager contacts the User to confirm product availability (servers, networking equipment, components), agree on delivery terms, and issue an invoice or inform about payment methods.

5.2. The User may cancel the order without penalties until it is confirmed by the manager. After confirmation, cancellation is subject to the rules set out in the Return Policy and the Consumer Rights Protection Law.

5.3. The Administration reserves the right to refuse to fulfill an order if the product is out of stock or if the User’s contact details cannot be verified (notification will be sent via email).

6. Liability and Limitations

6.1. The Administration is not liable for:

• delays or failures in the Site’s operation caused by force majeure, third-party actions, or internet provider issues;
• losses arising from the use or inability to use the Site, except as provided by law;
• the accuracy of information provided by the User (the User bears the consequences of any errors).

6.2. If the User violates the terms of this Agreement, the Administration reserves the right to block access to the Site or certain functions without prior notice.

6.3. The Administration does not control and is not responsible for the content of third-party sites linked from the Site.

7. Processing of Personal Data

7.1. By providing personal data through forms on the Site, the User consents to their processing in accordance with the Privacy Policy and the separate document “Consent to Personal Data Processing”.

7.2. The User may withdraw consent by sending a written notice to inquire@ghi-servers.ru.

8. Newsletters and Advertising

8.1. With the User’s consent, the Administration may send informational, service, and promotional messages (about promotions, new products, technical updates).

8.2. You may unsubscribe by clicking the “Unsubscribe” link in any email or by notifying us via inquire@ghi-servers.ru.

8.3. Advertisements displayed on the Site (Yandex.Direct, VK Advertising, targeted ads) are marked in accordance with the Federal Law “On Advertising”.

9. Dispute Resolution

9.1. User claims shall be considered by the Administration within 10 business days from receipt of a written complaint sent to inquire@ghi-servers.ru.

9.2. If no agreement is reached, the dispute shall be submitted to the court at the Operator’s location (Omsk, Omsk Oblast) subject to mandatory pre-trial procedures.

9.3. The substantive and procedural law of the Russian Federation shall apply to all relations.
